Dear Mr. Cole,

As vice president and general counsel of the UCF state agency, we have determined you as the proper custodian with whom to place a public records request pursuant to Chapter 119, Florida Statutes, as you have legal responsibility for the care, keeping or guardianship of the records which we seek.

We have copied Mr. Heston in case you choose to delegate these lawful responsibilities to him.

We are writing today to request, pursuant to Chapter 119, Florida Statutes, the following records relating to how the UCF state agency and its agents/affiliates (such as the UCF athletics association) have handled the tragic death of Ereck Plancher, the UCF football player who died after a workout:

— Any and all records of statements/interviews of Plancher’s teammates, coaches, football staff, other witnesses, etc., taken following the collapse of Plancher.

We are willing to pay lawful and reasonable costs associated with this request, but please give us an estimate of these costs and keep a record accounting of each costs. In the event you should claim any records are exempt or confidential, we invoke our rights under Section 119.07(1)(e)-(f), Florida Statutes, that you state the basis of the exemption that you contend is applicable to the record, including the statutory citation to an exemption created or afforded by statute, as well as explain to us in writing and with particularity the reasons for the conclusion that the record is exempt or confidential. If you intend to deny this public request, in whole or in part, please after citing the statutory exemption upon which you rely, redact that portion you assert is confidential or exempt and release the remainder of the records.
